Privacy Policy

This Privacy Policy describes the types of information Colony Cooks Management LLC (referred to as “Colony,” “we,” or “our” as applicable) collects from and about you when you visit our website(s) (the “Site”), create an account, or place an order for pickup or delivery (collectively, the “Services”). This Privacy Policy also explains how Colony may use and disclose such information, as well as your ability to control certain uses of it.

By using the Site, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy, and agree to Colony’s Terms of Service, which are incorporated by reference. If you do not agree, please do not access or use the Site.

1. Information We Collect

There are several ways we may obtain information about you, including through (A) information you provide to us directly; and (B) information that we automatically collect. This includes data that identifies you personally whether directly (i.e., your name) or indirectly (i.e., information about your online use).

A. Information You Provide

Colony collects information from you when you choose to share it with us. This may include when you use our Site, register or create an online account with or through the Site, purchase products or services, request information from us, sign up for our email or text list, join or organize a group order, request customer support, or otherwise communicate with or contact us. The information we collect may include:

  • Contact and account information — your name, email address, telephone or mobile number, and, if you create an account, your account credentials.
  • Order and delivery information — the items you order, your pickup selection or delivery address(es), delivery instructions, group-order participation, and scheduling preferences.
  • Payment information — payment card details, which are collected and processed by our third-party payment processor. Colony does not store your full card number; we may retain limited details such as the card brand and last four digits to help you check out faster.
  • Communications — information you provide when you contact support or otherwise communicate with us, Merchants, or delivery providers.

B. Information Automatically Collected

Whenever you visit or interact with the Site, we and/or our service providers may use a variety of technologies such as cookies or other similar technologies to automatically or passively collect certain information about your online activity. We automatically collect the following information about you:

  • Computer or device information. We may automatically collect your Internet Protocol (“IP”) address or other unique identifier or information from the computer, mobile device, tablet or other device you use to access the Services, including but not limited to your browser type, device type, operating system, software version, phone model, phone operating system, and the domain name from which you accessed the Services.
  • Usage information. We may collect information about your use of the Services, including the date and time you visit, the areas or pages you visit, the amount of time you spend, the number of times you return, and the addresses and searches you enter while browsing (including when browsing without an account). We may also collect information about where traffic and purchases on our Site originate.
  • Location information. To show nearby restaurants and delivery availability and to fulfill delivery Orders, we may collect approximate or precise location information derived from your device or from the delivery address you provide.

2. Information Use

Colony may use the information we collect from and about you for any of the following purposes:

  • To respond to your inquiries, take and fulfill Orders, coordinate pickup and delivery, support group and scheduled orders, and contact and communicate with you when necessary;
  • To process payments and prevent fraud, and to use and disclose your payment information only to process payments and prevent fraud;
  • To enhance your online experience, including as a way to recognize you and welcome you to the Site;
  • To review the usage and operations of our Site, develop new products or services, and conduct analysis to enhance or improve our content, products, and services;
  • To provide you with customized Site content or promotional materials, subject to your choices;
  • To use information about site visitors for analytical and demographic purposes;
  • To send you transactional and, where permitted, promotional messages by email or text (see Section 6);
  • To address problems with the Site or our business, and to protect the security or integrity of the Site and our business; and
  • For other purposes disclosed at the time you provide your information or otherwise with your consent.

Additionally, if you use the Site to connect with third-party Merchants, delivery providers, or payment processing service providers, you authorize us to use information from and about you, on your behalf, to interact with these third parties based on your requests.

3. Information We Share With Others

We may share your personal information with the following:

  • Merchants. We share the information necessary to prepare and fulfill your Order with the restaurant or food brand (“Merchant”) fulfilling it.
  • Delivery providers. For delivery Orders, we share the information necessary to complete delivery — such as your name, delivery address, and contact details — with the independent contractors and/or third-party delivery networks and services that perform delivery. Contact between you and a delivery person may occur through masked or proxy phone numbers.
  • Service providers. We may share your information with third-party service providers that provide business, professional or technical support functions for us (including payment processing, text/email messaging, mapping and routing, hosting, analytics, and error monitoring), help us operate our business and the Site, or administer activities on our behalf.
  • Legal matters; safety. We may access and disclose your information to respond to subpoenas, judicial processes, or government requests and investigations, or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law. We may disclose your information to protect the security of our Site, servers, network systems, and databases. We also may disclose your information as necessary if we believe there has been a violation of our Terms of Service, any other legal document or contract related to our services, or the rights of any third party.
  • Sale or transfer of business or assets. We may sell or purchase assets during the normal course of our business. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should such a sale or transfer occur, we will use reasonable efforts to require that the transferee use personal information provided through this Site in a manner consistent with this Privacy Policy.
  • Other. We also may share your information as disclosed to you at the time of collection.

We do not sell your personal information.

4. Cookie Notice

Certain parts of our Site require cookies. We and our analytics providers may also use cookies and similar technologies to understand and improve how the Site is used. You may adjust your device or Internet browser settings to limit certain tracking or to decline cookies, but by doing so, you may not be able to use certain features of the Service or take full advantage of all of our offerings. Please refer to your device’s settings or your Internet browser’s “Help” section for more information on how to delete and/or disable your device or browser from receiving cookies or controlling your tracking preferences. Our system may not recognize Do Not Track requests or headers from some or all browsers.

5. Third-Party Content, Links, and Plug-ins

The Site may have links to third-party websites, which may have privacy policies that differ from our own. We are not responsible for the practices of such sites.

6. Text Messages (SMS)

If you provide your mobile phone number — for example, when you create an account or place an Order — you consent to receive transactional text (SMS) messages from us and our service providers relating to your account and Orders, such as verification codes, Order and delivery status updates, and communications with Merchants or delivery providers (which may be exchanged through masked or proxy numbers). With your consent, we may also send promotional messages. Message frequency varies, and message and data rates may apply. You can opt out of non-essential messages at any time by replying STOP, or reply HELP for help. Opting out of certain messages may affect our ability to provide Order updates. Consent to receive marketing or promotional text messages is not a condition of any purchase. We do not sell or share your mobile information with third parties for their own marketing purposes.

7. Children’s Privacy

Protecting children’s privacy is important to us. We do not direct the Site to, nor do we knowingly collect any personal information from, children under the age of thirteen. If Colony learns that a child under the age of thirteen has provided personally identifiable information to the Site, it will use reasonable efforts to remove such information from its files.

8. Your California Privacy Rights

Colony is based in California, and California residents have certain rights regarding their personal information under the California Consumer Privacy Act, as amended (the “CCPA”). Depending on your circumstances and subject to certain exceptions, you may have the right to:

  • Know and access the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for collecting it, and the categories of third parties with whom we share it;
  • Delete personal information we have collected from you;
  • Correct inaccurate personal information we maintain about you;
  • Opt out of the “sale” or “sharing” of your personal information — note that we do not sell or share your personal information as those terms are defined under the CCPA; and
  • Non-discrimination — we will not discriminate against you for exercising any of these rights.

To exercise any of these rights, contact us using the details in Section 11. We will verify your request before fulfilling it and will respond as required by applicable law. You may use an authorized agent to submit a request on your behalf, subject to verification.

9. Data Retention and Security

We retain personal information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. We use reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Revisions to This Privacy Policy

We reserve the right, at our sole discretion, to change, modify, add, remove, or otherwise revise portions of this Privacy Policy at any time. When we do, we will post the change(s) on the Site. Your continued use of the Site following the posting of changes to these terms means you accept these changes. If we change the Privacy Policy in a material way, we will provide appropriate notice to you.
